That includes not just our products themselves, but also the way we package, advertise and distribute them. In light of the recent amendments made to California’s Proposition 65, we’ve recently revisited how we plan to comply with the regulation’s new changes.
What is Proposition 65?
California’s Proposition 65, also called the Safe Drinking Water and Toxic Enforcement Act was enacted in 1986. A recent amendment changed the specifications on how and when to label products with a warning.
Proposition 65 started as a ballot initiative passed by Californians as a way of informing and protecting residents against potentially harmful, carcinogenic chemicals. The state developed a list of these substances, which the governor publishes each year. While some are natural and others synthetic, they can be found in a variety of products and things across the market.
The new amendment to Proposition 65 states that starting August 30, 2018, any product sold in or to someone in California has to comply with certain label requirements. If a product contains chemicals listed by the state of California to cause cancer or reproductive harm, they must have a clear and reasonable warning present at the time of purchase.
This warning would take the form of a physical label, a sign in a retail location, or as part of the description on the website at the point of purchase. It’s a way to make California consumers more aware of what’s in the items they purchase.
How does Proposition 65 apply to PowerStop, and how is PowerStop responding?
Companies and businesses are independently responsible for their decisions to provide or not to provide Proposition 65 warnings. This means that the state of California doesn’t require information about products and then determine what should and shouldn’t receive labels. Rather, it’s up to companies to know their products, step up and comply with the regulation.
That said, we’re taking the initiative here at PowerStop to inform our customers about their purchases. Proposition 65 applies to all products including brake parts. Since it applies to all brake parts sold in the California market, that includes all of our PowerStop products.
PowerStop takes all regulations very seriously, and we always make every effort to ensure all products comply fully with these rules. We are in the process of having products tested to see if any contain chemicals from California’s list. In addition to PowerStop’s testing, all PowerStop suppliers are performing the same testing so the results can be double-checked.
As a precaution, you’ll be seeing the warning on or near all of our PowerStop products until we’ve completed the necessary testing. When results are received, warnings for specific products will be reviewed and may be determined as still necessary, modified or removed.
PowerStop is working towards full Proposition 65 compliance

Between our efforts and our distributors’ efforts, PowerStop is confident that we will be 100 percent Proposition 65 compliant when the new amendment goes into effect at the end of August 2018.
FAQ’s
Q: I see the warning label on the box. Am I in danger of having this part on my shelf?
A: No, there is no immediate danger having the part on your shelf. PowerStop does recommend using safety glasses, gloves, and a dust mask when handling the parts themselves and/or installing brake parts on vehicles.
Q: What is the primary method I can be exposed to the toxic substances that the warning label is referring to?
A: Primary method would likely be inhalation when brake dust becomes airborne. Other methods are skin transmission (dermal) or through swallowing (ingestion). To reduce the risk of exposure, PowerStop does recommend using safety glasses, gloves, and dust masks when handling the parts themselves and/or installing brake parts on vehicles, consistent with OSHA recommendations for the performance of brake mechanic work.
Q: I am a retailer in the state of California. In addition to the warning label on the product, what extra measures can I take to ensure compliance?
A: PowerStop is here to support extra measures for compliance. We are able to send you extra labels as needed, and we can also provide a 12″ x 12″ sign with the warning so that it can be placed to inform customers of the warning.
Q: I am a retailer in the state of Calfornia. I don’t like having these warning labels on the product in my store so I want to remove them. Am I free to do so?
A: No, according to state law, these labels need to be present on any products that could result in exposure to one or more of the 900+ chemicals on the Proposition 65 list. Please leave the labels intact on the product.
Q: I am a retailer who is not in the state of California. Do I need to have a sign or make an extra effort to warn customers about the toxic substances that the warning label is referring to?
A: Prop 65 applies only in California and you should investigate the laws and regulations in other states as to what they may require.
Q: I am a retailer who is not in the state of California. Why does the product you shipped me have California Prop 65 warning labels on it?
A: Since many of PowerStop’s distributors are “omnichannel” and products from many locations have the possibility of being shipped to CA, PowerStop has decided to label all of our products appropriately to ensure compliance with Prop 65. This is a safeguard for the distributor as well as PowerStop.
